A court in New Mexico has mandated that Meta allocate $567 million to a fund dedicated to mitigating mental health issues purportedly linked to its social media platforms’ impact on children. This decision comes after a jury in March determined that Meta was aware of the potential harm to children’s mental health and did not adequately tackle child sexual exploitation across its platforms. With this recent order, the financial burden on Meta for this case has now reached a total of $942 million.
The recent ruling specifies that $420 million of the awarded amount is designated for mental health treatment services targeting young individuals in New Mexico. The remaining funds are intended to bolster prevention initiatives, raise awareness, and support screening services, among other interventions, over the coming five years. In addition, the court has instructed Meta to enhance the safety measures for children on its platforms, Facebook and Instagram. This includes refining age-verification processes, providing clearer guidance on safety and privacy features, and creating systems to pinpoint users who might be under the age of 13.
Furthermore, Meta is expected to collaborate with schools or child-safety organizations to set up a mechanism for flagging accounts that might belong to children under the age of 13. The company is also obligated to delete any personal information collected from users under this age threshold and must submit semi-annual progress reports to demonstrate compliance with the court’s directives. However, the court did not impose a universal age verification requirement solely within New Mexico, citing concerns about fairness and existing federal privacy protections for children.
In response to the ruling, Meta has expressed its disagreement and intends to appeal. The company asserts its commitment to protecting its users and highlights the steps it has already taken to address harmful content and enhance online safety. This case adds to the increasing legal scrutiny Meta faces regarding allegations that its platforms could negatively affect young users. Similar legal actions are underway in other states across the United States.
