In a legal confrontation that has captured significant attention, Apple has initiated a lawsuit against OpenAI, claiming that the artificial intelligence firm misappropriated confidential trade secrets pertaining to Apple’s hardware development, manufacturing processes, and supply chain dynamics. The lawsuit, filed in a US federal court, centers on allegations that former Apple employees who transitioned to OpenAI unlawfully retained and disclosed proprietary information, allegedly granting OpenAI an undue edge as it pursues its own consumer AI hardware projects.

Apple’s complaint points to various former employees, accusing them of aiding OpenAI by accessing sensitive Apple information. The tech giant alleges that these individuals, upon joining OpenAI, retained data improperly, sought out Apple’s suppliers, and attempted to extract confidential details during recruitment processes. Notably, the lawsuit references ex-Apple executives and engineers, including Chang Liu, who is specifically accused of not returning a company-issued laptop after his departure. Another key figure in the allegations is Tang Yew Tan, a former senior executive at Apple who later assumed the role of Chief Hardware Officer at OpenAI. Apple contends that Tan engaged with OpenAI affiliates and Apple suppliers before officially leaving the company.

Apple asserts that OpenAI and associated entities have systematically targeted its proprietary technology and expertise, hoping to fast-track their venture into the consumer AI hardware sector. This strategy allegedly involves leveraging Apple’s confidential technology, manufacturing acumen, and robust supply chain networks. With over 400 former Apple employees reportedly now working at OpenAI, the lawsuit underscores the scale of the workforce transition and the potential risks it poses to Apple’s competitive standing.

The Cupertino-based company is pursuing both preliminary and permanent injunctions to halt any further use of its trade secrets by OpenAI, in addition to seeking financial compensation for what it describes as deliberate and harmful misappropriation of its proprietary business information. Apple claims it has previously attempted to address these concerns directly with OpenAI but received no acknowledgment of its grievances. As of now, OpenAI has not issued a public response to the allegations detailed in the lawsuit.
